SEE NOTICE BELOW my review of BANKRUPTCY PROCEEDINGS: Submitted order on 3/25/2011 that included my credit card number. Received an email on 4/7/2011 stating the payment must be made with check or my bank's bill pay, and that my credit card will not be charged for this order. (My credit card was not charged.) I mailed check to the company on 04/7/2011. The check cleared the bank on 4/12/2011. On 4/27/2011 I sent the company an email requesting a ship date. The response was that they were backed up and the roses would be shipped on 05/6/2011. I sent another email on 5/12/2011 to find out if the roses had been shipped, and if not, I asked for a refund. Received a response on 5/12/2011 that my money would be refunded. I have heard nothing since 5/12/2011. All emails to the company are returned delivery failure. The company telephone number 805-321-3900 has been disconnected. The cell number for the owner, Chris Gilcrest, 805-625-1257, is not answered. I will file a complaint with the Better Business Bureau of California, the Office of the Postal Inspector for mail fraud (payment sent through USPS), and the Attorney General of California for Fraud. NOTICE:This company has filed Chapter 7 bankruptcy. Under federal bankruptcy laws, Chapter 7 allows for liquidation of assets. For |information about filing a claim as a creditor, contact the clerk of the bankruptcy court. The company has been including the following message to it's customers in complaint responses. "I have filed for Chapter 7 Bankruptcy protection, The and your refund or the shipping of your item(s) will waiting until the conclusion of these proceedings. The filing of the Chapter 7 was not or is not an effort to dissolve the money or obligation I have to you. I have larger issues that have clouded over myself for many years that needed this resolution. This is not the first, second or even third attempt to file this Chapter 7 petition. I have got the process started before only to run into various complications and issues. There will be no distractions this time. The amount of the money owed to you is not an issue in of itself but the need to for me to a legal time frame and method to make ALL refunds or ALL shipments is needed. I can only do all of this from the very large amount of revenue the late winter and spring sales I have. The legal means to protect the obligation for the money owed to you is a Reaffirmation Agreement.
